New regulation on shipping fees and charges

On January 05th 2016, the Ministry of Finance issued Circular 01/2016/TT-BTC on shipping fees and charges and a table of shipping charges and fees, applicable from February 20th 2016.

The circular provides that the followings are subject to fees and charges according to the table of fees and charges of international shipping activities: Vessels on exit, entry or transit, passing through or anchoring in a maritime area (including processing zone); foreign vessels operating in Vietnamese waters outside the seaport area; Vessels conducting transport activities for exports, imports, transits of commodities in maritime zones including processing zone; Vessels transporting passengers from Vietnam to foreign countries and vice versa; Specialized Vessels operating on international routes entering and leaving, passing or anchoring in the maritime area ...

Fees charged on tonnage

According to the circular, vessels entering and leaving the maritime areas, specialized ports, or offshore petroleum ports; foreign vessels operating in Vietnamese waters outside seaport areas must pay a fee charged on tonnage at the rates as follows:

The Circular also specifies the following cases which are not subject to tonnage charges: Vessels entering and leaving maritime areas for seeking storms shelters or avoiding bad weather which is unsafe for the operation of the vessels, nor medical emergency treatment, for handing over patients rescued at sea without loading or unloading goods, for picking up or dropping off passengers as confirmed by the port authorities; Vessels engaged in search and rescue, flood and disaster prevention activities under the mobilization order or the consent of a competent state authority; Vessels of foreign armed forces coming to the maritime areas for official or courtesy visits at the invitation of the State of Vietnam; Foreign vessels with youth delegations on board coming for cultural or sport exchange at the invitation of ministries or ministerial-level agencies under the Government of Vietnam...

In addition, the Circular also stipulates the fees and regulations on maritime security charges; navigation (pilot) charges; anchoring charges; fees for using wharves, mooring buoys in the marine areas; seaport enter – exit fees and authentication fees for maritime appeals.

The Circular takes effect from February 20th 2016.
